On Friday’s Mark Levin Show, Gov Ron DeSantis is enforcing immigration law! He announces that Alligator Alcatraz is now deporting illegal immigrants, and the Democrats hate it. Also, President Trump’s advisors are mistaken in claiming blanket absolute immunity under the Supreme Court’s Presidential immunity ruling. The decision provides absolute immunity for core presidential duties but only presumptive immunity for peripheral ones, which can be rebutted if actions fall outside legitimate responsibilities. Yes, Barack Obama can be investigated for the Russia collusion hoax.

Later, Hans von Spakovsky calls in to explain that Senate Republicans are perpetuating a tactic originated by former Democratic Senate Majority Leader Harry Reid in 2007, using “pro forma” sessions—brief, token meetings every three days during congressional breaks—to prevent the Senate from entering a true recess. This blocks Trump from making recess appointments under the Constitution, leading to significant delays: only 86 nominees confirmed six months into his term, with 256 still pending and no U.S. attorneys approved, forcing reliance on acting officials. What are the Republicans doing?! There is no defense for this.  Afterward, Israel is supplying food, medicine, and necessities, but these are being held up by Hamas, which is desperate to survive. Hamas steals food, tries to starve the Gazans, then blames Israel, and the media runs with it. I will be on Hannity tonight for one short segment. We’re in the same studio in Florida, the Mark Levin studio. You know, we don’t get to see each other as much as we used to, but he’s really the best. We are like brothers. Very, very close. For several decades now. And he’ll be interviewing me for my Sunday show. We’ve got two terrific shows this weekend. I hope you’ll set your DVR. I hope you show up in person. Turn your TV on 8 p.m. Eastern Saturday, 8 p.m. Eastern Sunday. On Saturday, I will reveal like nobody else. The scandal involving Barack Obama as the mob boss on this Russian hoax. And I’m sure you’re going to want to see that. And I’m joined for half of the show by our friend Ben SHAPIRO. So just one guest. I wanted to get back to that a little bit. Time to time. Well, one guest from time to time will have to. But I love the deep dive with the guests, who I really like and who I think can provide so much. Interesting and compelling information. And then Sunday show, it’ll be a real deep dive on this whole notion of power. I think you’re going to find it. Absolutely. Intriguing. I love this guy. We live in Florida. We also live in Virginia. But Florida is my residence. There is no better governor. I can’t think of any better, Governor, ever. When it comes to spending and taxes, do you know that he’s paid down half the debt of the state of Florida, debt that’s been compiling over the course of 100 years? I mean, he’s a very responsible, fiscally responsible governor. He’s a law and order governor. He’s an education governor. I just think he’s fantastic. And yes, I think he’s presidential material very strongly. Do I believe that? So we shall see. We shall see. But he’s done everything conservatives and constitutionalists would expect somebody like him to do. Right. You have other people who make these promises? No. He’s also smart on foreign policy. He’s not an interventionist, but he’s not an isolationist. This is a key factor. So I’m very high on Ron DeSantis. Sure, there’ll be others who are very interested in running one day. I haven’t talked to them about it. Honestly, I haven’t. It’s a little too early for that. We’ve got midterms coming up and other things that we have to do to advance this society right now. So here he is at Alligator Alcatraz. And of course, he’s having a press event there talking about it. And this alligator, Alcatraz. You know, you listen to the name, you think, Oh, my God. Well, there they are in the middle of, uh, what the swamps and everything. This is a place that was already built, no doubt, by the Democrats, because the Democrats used to control Florida. Hook, line and sinker. Doesn’t really matter. So. The foundational infrastructure was already there and they built it out and built it on top of it. And of course, they’re under attack, but they don’t care. That’s the thing about being a principle constitutionalist. You know, when you’re right and that’s what you do, you advance the cause. So here he is today. Cut 13. Go. So I’m pleased to report that those flights out of alligator Alcatraz by DHS have begun. The cadence is increasing. We’ve already had a number of flights in the last few days. We’ve had hundreds of illegals have been removed from here. And, you know, the federal government has a process of how they eventually do. And they’ve done it different ways on some of these different flights. But the reality is, is this provides an ability to enhance the mission, to increase the number and frequency of importations. And so what’s been done here has really been a mark. Remarkable. There’s full ground to air communications from the airfield. There’s air tracking radar capabilities on side security, securing all access ports to the taxiway and runway on aircraft arrival. That happens. You got 5000 gallons of jet fuel on site. You got runway lighting. You got everything you need to be able to do that. This airport is able to accept commercial sized aircraft and conduct both day and nighttime operations. And so that’s what it’s all about to be able to help process and remove folks that are illegally in the state of Florida and in the United States of America. So we look forward to this cadence increasing. And that drives them nuts. Tribes have not is enforcing immigration law. You’re here illegally, you’re to be deported. That’s what federal law says America doesn’t say. Only if you commit the most heinous of crimes. That’s not what it says. Cat 14. Go. There’s the whole family. Help me with my medication. Can you explain this? So I let Kevin, but I’m sure he’s going to debunk it. I mean, like I seriously, you know, you have to ask yourself on some of this stuff, just the desire to, like create narratives and like these Democrat politicians parading down here and doing all this stuff. And I’m just thinking to myself, I’ve never seen one of you show up to comfort an angel mom who’s lost a child because of illegal alien crime. I’ve never seen you raise any concern about the victims of illegal immigration. Not one time have I seen these Democrats caravan anywhere in this state. Hold a press conference to be able to stand in solidarity with victims. I’ve never seen that. These are stunts that they’re pulling because they’re increasingly politically irrelevant in this state and they’re trying to latch on to whatever they can to create a phony narrative. Outstanding response. I believe she was asking about medications that. One of the people there didn’t have their medicine. It’s incredible. You can go home and get your medicine to another country. Daniel Carter is a Chicago resident. She was at a Chicago Public Safety Committee meeting yesterday. Urging local officials there to work with ICE. And of course, they have no intention of working with ICE because they’re part of the Confederacy. Now that is nullification of federal law, and that was basically what the Confederacy was all about. Cut 15, go. We just so we are we have illegal aliens that all you all men that was just in here fighting for illegal aliens. They are right now we just had a legal alien killer Illinois one man Megan Boles stuff our body and bleach in a container a to let him off. And we know that you all arrest these illegal aliens and let them right back out in our community. And now you all want to tell us and all of you all were advocating to keep them here and due process and you want to keep them in our communities and not allow ICE to come in, even get the criminals, the public safety threats. If we was working with ICE, then he had a deportation. He’s he’s supposed to be deported. So if we were working with ICE, then he wouldn’t have been he will have been out of our country, out of our communities. But now you all were down here just the prior meeting advocating for their rights, their due process, and how their rights are being violated, all while our rights are not our what? We are not being protected. So I didn’t see one of you all to miss mention about the lady, Megan Bowles, who had just lost her life from a legal alien that you all allowed to come into our communities and not cooperate where ICE or law enforcement can’t lock them up. And you all will keep coming to us about safety threats. You all in this, right? The all the mess. Our people who are put in charge, the mayor. You all are the safety threats. The Democratic Party. You all are the safety threats to the American citizens. Good for her. Really good. We’ll be right back.

Segment 2

Whoever is advising the president, whatever lawyers are advised in Iraq, the Supreme Court decision on July one, 20, 24, a year ago, when the immunity issue does not grant blanket absolute immunity. It does. For the vast majority of what a president does. But there’s also what we talked about the other day, presumptive immunity that is raised in the opinion by John Roberts, who wrote it. It is a presumption that could be overcome. That’s why it’s called presumptive immunity. That means on the outer skirts, the outer circle of a presidential of a president’s duties and responsibilities under the Constitution. He’s given the benefit of the doubt. However, if offenses are committed or potentially committed. Then that can be pursued if they’re not in the normal course of what a president does. I’ve given a perfect example of this two cases with Obama when he took out for a soiree, I believe the German gentleman, the terrorist name, was in Yemen who had been an imam in northern Virginia. Two of the hijackers were among his attendees at his mosque. He was an al Qaeda operative, a senior official, and he escaped the United States. To Yemen. And Obama ordered a strike against him to kill him. And I’m glad he did. And he also killed his son unintentionally, I’m sure. But he was 15 years old and a U.S. citizen. So if there’s no immunity there, the family may have had a reason to bring some kind of a claim against the president and so forth. But of course, that’s immune. That is an example of something that is a part of the president’s duties, official duties, squarely within his responsibilities. Okay. That’s an example. A contrary example is if a president like Obama. Directs his intelligence services to create a new assessment, an assessment that contradicts the existing assessment. That involves Russia and Trump and so forth and so on for the purpose of sabotaging the incoming presidency. And to further underscore that is, he insists. Did that that assessment be done by early January. So it was done less than a month before he was leaving office. There was only one reason he did that, and that was to cook the books when it comes to intelligence. There was no other reason to do that. And so that does not fall within the legitimate functions of a president’s duties, his constitutional duties. That is seeking a report, yes, but seeking a changed report for the purpose of using that report to sabotage the incoming president is not. So I would quibble more than that. I would strongly reject the advice the president may be getting with respect to this absolute immunity that would apply in a case like this. Now, that said, the question is what crime? What crime would it involve? If, in fact, they’re able to determine and they are, that Obama did these things. That’s a harder case. I can’t find one right now. I can find the outer limits of one. But it would be very difficult. And as I went through the various criminal statutes and so forth, however, in the course of investigating Obama, questioning him, requiring him to provide, you know, documentary material, whether it’s emails or texts or or physical documents and all these sort of things, phone logs, um, if he had destroyed something or was trying to cover up or whatever, then we have, as you know, what I call process crimes. So you could have obstruction. You could have if it’s under oath, you could have perjury. If it’s not under oath, you can have false statements to a federal official. So these things do kick in. So an investigation is worthwhile. An investigation is important. And you don’t need probable cause to open a criminal investigation. Just reasonableness is kind of the standard, which is a very broad and ambiguous standard. That’s what you need. And there’s more than reasonableness here as far as I’m concerned. I wanted to point that out. President Trump this morning. He’s outside the White House and of course, they bring up Epstein. Now, the Democrats in the media had no interest in Epstein when the Democrats were in control, they never brought it up. I don’t believe I ever heard them bring it up. They’re trying to smear Trump is what they’re trying to do. And you could see it on. And really disgusting propaganda operations like Media eight and Dry Gin and the rest of the media. You can see it. Where they have a picture of him with Epstein or they think they have notes or something like that. The fact is he doesn’t deny that he knew Epstein. He doesn’t deny that that they were I wouldn’t say friends, but acquaintances as he is with many people. But about 20 years ago or so, he threw them out of Mar a Lago and wanted nothing to do with them again. So that’s all known. But you see the Democrats in the media, in some of the Republicans, this is a game with them. When we come back, I want you to hear what the president had to say about he made a great point when he was outside of the White House today. We’ll play that. And as for Stephen Colbert, I want to say this to you, just as as we dance our way to the commercial. As a lowlife. He keeps trashing CBS, trashing CBS, trying to create a cause celeb. He’s a loser. They were losing $40 million. $40 million. He’s not a comic. He’s a bore. He’s not even a political commentator. He’s a moron. That’s that. I’ll be right back.

You ought to be speaking about some of his friends that are hedge fund guys. They’re all over the place. You ought to be speaking about Bill Clinton, who went to the island 28 times. I never went to the island to write a letter for Jeffrey Epstein. I don’t even know what they’re talking about now. Somebody could have written a letter and used my name, but that’s happened a lot. All you have to do is take a look at the dossier, the fake dossier. Everything is fake with that administration. Everything’s fake with the Democrats. Take a look at what they just found out about the dossier. Everything is fake. They’re a bunch of sick people. Poor guy has to keep fighting. And he’s always right about this stuff. Now they said, Did you not write the letter? He just brought a lawsuit. Challenging the use of that letter that it was in his. But the media, they’re all worked up about it. They’re not going to stop. Because they think this is a big issue. This is their issue. It’s a good question. Larry Summers, I don’t know what his involvement might be. Bill Clinton, we all know that he was very close to this guy and so forth. But the Democrats have nothing else to discuss. So this is it for them. Here’s how it’s good at Mr. Producer. Here’s this summer Lee Sommer Lee is a radical kook. Marxists, Islamists. Lowlife is what she is. Out of Pittsburgh. Pittsburgh. On CNN today and CNN’s pushing this stuff and MSNBC’s pushing this stuff. And anyway, cut. What is it, 18? Go. Do you think Maxwell has some kind of incentive to protect the president? I think it’s a possibility. Right. Well, the question I have before we get to the geniuses here. Is this a news program? So how is it news? They ask a left wing Democrat Congresswoman. If she thinks. That Maxwell has an incentive to protect the president. How is that newsworthy? It’s not. So what is the purpose? The purpose is to advance a narrative. Now this guy, you’ve seen him, John Berman, is dumber than a doorknob. Guy’s a moron. But most of them are at CNN. You have to have a very low IQ, too, to get a job over there. Go ahead. The way in which the president has kind of just like handed out pardons and commutations, you know, like, can’t be right. This is somebody who, if you must be confusing him with Biden. Biden and the autopen. Handed out pardons like candy. Thousands and thousands of them. Thousands and thousands that I say thousand. So summarily has nothing substantive to offer. She doesn’t know anything. She shooting from the hip? And just on the attack. And that’s why CNN has no ratings. There’s literally no news here. Go ahead. Permission we have. True. And there’s been a lot that has leaked not just over the years, but this very week about the president being briefed that he that he shows up on the list multiple times. Great. If that’s true, it doesn’t say he shows up on a list multiple times. I believe the story was that his name is in the files. And so what? For all I know, there’s a lot of names in the files, and this is one of the reasons this judge in Florida wouldn’t release the grand jury information only because they’re not supposed to under rules 60. But because a lot of innocent people will be damaged. That’s the point. But the Democrats don’t care. Their whole play is to damage people. They don’t like to make insinuations, to smear. This is what they do. Go ahead. Inclined to give pardons for those who, you know, maybe help him to continue doing. I think it’s very clear that the president does not want this out. I think it’s clear from his complete 180 on the clear that the president doesn’t want it out. When he told the Department of Justice to release whatever they have. That is legitimate. So how is that? Not wanting it to get out, whatever it is. And so here we are. Here we are chasing the moon. Chasing the moon. He doesn’t want it to get out. Go ahead. There is something to hide, I think, just from the clip from Mike Johnson, even he’s now saying that there’s something there. So if I were, you know, I think that we can all reasonably believe that. Right. The late Maxwell, who probably would not want to live the rest of her life in prison, would maybe think that this is her one shot, if not her final shot at some sort of relief or who knows? Who knows? But what could she possibly say that would help Trump Mr. Produce that he’s not in the records. Well, if he’s not in the records, that’s a fact. Not ought to be known. But what can she. But I’m sitting there. What is it that she could say that would help? He’s an innocent man. He hadn’t done anything. So what is it that she could say? He’s an innocent man. He hasn’t done anything. Do you think Summer Lee and her ilk on the radical left are going to accept that as the final say? Of course not. So I’m sitting here thinking, what exactly would you get in exchange for a pardon? What would she say? But the report is too stupid to have a follow up question. Too stupid to have a follow up question. Then there’s this guy, Chris Murphy, Democrat of Connecticut. This guy is death warrant over. That’s what he looks like. He’s got. He’s Mr. Pasty. That’s what he is. Pasty. And he dies his hair. So you see people like that, They look like killers, don’t they, Mr. Producer? They die their hair really dark, black. Their skin is very, very pasty. No offense. I’m just being honest. Plus he has that weird, stupid, constipated look on his face all the time. This guy does more TV than I do. And he’s a senator. There’s more TV than I do. And I’m paid to do TV. Got 17 go. Yeah. I mean, listen, I think broadly what you’re seeing is the number one priority for this administration, which is the protection of the rich and powerful. So how is this news? On MSNBC. It’s not news. And what does that mean? The protection of the rich and powerful. How does that work? Exactly. We’re going to protect the rich and powerful. And how are you going to protect them? What has Trump done to protect the rich and powerful? Nothing. Absolutely nothing. But they use this Marxist claptrap. Because that’s all they know. The rich and the powerful. I bet he doesn’t say that about Bill Gates or George or Alex Soros, does he? Go ahead. Let Donald Trump and his friends get away with illegality, corruption and immorality. Who who among his friends are getting away with illegality and corruption? Nobody. And what he’s alleged to be involved in illegality and corruption. And he’s not challenged. This psychopath just goes on and says stuff like this. And he’s not challenged. And this is how it works all the time. Go ahead. This is what the entirety of the first seven months of the Trump administration has been about. And this is probably the most beneficial. What? Tax cuts. For people get tips, tax cuts for overtime, tax cuts for many people on Social Security. Increased border security like we’ve never seen before. What’s his full talking about? School choice for poor people in the middle class. What does it have to do with the rich and the powerful to the opposite of the rich and the powerful, isn’t it? It’s the opposite. Go ahead of his power to try to conceal his corruption. He’s being transparent about the fact that the Department of Justice is not an independent legal arm. It is just his personal. Listen to this guy rambling on. Like he’s on something. And she doesn’t interrupt him in there. He is rambling on. Saying these things that are not true. This is what I call in the book negative language. Now, you might say, oh, big deal. You call it negative language. No, when you’re. You’ll see how it fits into a whole puzzle. This is a piece of it. So Chris Murphy isn’t interested in advancing any debate on any substance whatsoever. He’s not even interested in calling out real corruption or illegality. So he poisons the body politic. So many people in the public don’t know what’s going on. They assume the worse because of demagogues spewing propaganda in order to manipulate people. And that’s Chris Murphy. And that’s Chris Murphy in a healthy republic and a healthy republic. You’d have a debate on real issues, a debate on substance, a debate on policy. But the Democrats don’t believe in a healthy republic. The left doesn’t believe in a healthy republic. So they create this this sort of a counter. Culture, this culture. Reality, which is a non-reality. In which they operate. In which they operate. Go ahead. But it is now staffed by people who are loyal only to Donald Trump, not loyal to the law and not loyal to the Constitution, not loyal to the American people that be. In less than 60 seconds. The allegations this man has made about corruption, the law. The rich. Loyalty. And on and on and on. Are just wild, outlandish statements. That’s all they are. And he’s on a news program. I think it’s on me. LSD. We’re just free to talk this way. He actually has no information whatsoever. He has no facts whatsoever. But there he is spewing away. I’ll be right back.

There’s something going on that’s very disturbing to me. And that is the judges. Why aren’t we appointing more judges? Does anybody know the answer to that? Well, we’re going have a guest on in about 30 minutes who’s going to help us out. Hans von Spakovsky from the Great Heritage Foundation. And he’s written a piece in the Daily Signals. Senate Republicans Continue Harry Reid’s Nominee Blockade. They’re blocking themselves. Says Harry Reid, the former Democrat leader of the U.S. Senate, left the Senate in 2017 and died in 2021. But his ghost must still be haunting the chamber. How else can one explain why the Republican majority is continuing the blockade Reid initiated back in 2007 to prevent a Republican president? Reid back then, George W Bush from using recess appointments to get around the various roadblocks Reid put in place to delay confirming Bush’s nominees. We need to dig into this. As of July 22, there were 256 nominations pending in the Republican Senate. It has been six months since President Trump was inaugurated, and in that time, only 86 nominees have been confirmed. Vital leadership posts and numerous government agencies remain unfilled, severely handicapping the president’s ability to make the changes that are needed and that were supported by 77 million Americans who voted for him in the 2024 election to reduce the size and scope of the bloated executive branch. I’ll bet nobody’s even told you about this. Not a single U.S. attorney. Not a single U.S. attorney. The lawyers responsible for vital criminal prosecutions all over the country has been confirmed. Not one. And there are 93 of them. Leading to fiascoes like Democrat appointed federal judges refusing to reappoint Allan Harbour as the temporary U.S. attorney in New Jersey. The president has been forced to yank her nomination from the Senate so she can continue serving as the acting U.S. attorney, all because her confirmation has been held up. There’s no justifiable reason for this situation to exist or for the current Senate, the Republican majority, to continue Harry Reid’s political strategy. So what are we talking about? We’re talking about the pro forma sessions that Reed implemented in 2007 so that the Senate is never formally in a recess as outlined by the Constitution. So this prevents the president, President Trump, from appointing federal officers who can start serving immediately to fill positions that otherwise require Senate confirmation. Section two of Article two of the Constitution provides the presidential power to fill up all vacancies that may happen during a recess of the Senate by granting commissions which shall expire at the end of their next session. In plain English, this means that when the Senate is not in session because senators have fled Washington to return to their home states and the Senate is unable to conduct any business such as confirming nominees, the president can fill those open slots in the executive branch, whether it is a U.S. attorney or an assistant secretary in some cabinet position, and that lasts until the end of that term of the Senate. So after two years and he can do it twice. So what are the Republicans doing? They’re blocking President Trump from doing this. So we want to dig into this next hour.
