No president — Democrat or Republican — has ever accepted the constitutionality of the War Powers Act. The Supreme Court has never ruled on it, and the Constitution clearly divides authority: Congress can declare war, but the President is the Commander-in-Chief.

The framers intentionally rejected giving Congress the power to “make war,” limiting it instead to declaring war, while the president executes military operations and foreign policy.
